Copyright & DMCA Policy

APOC Co., Ltd. (“APOC”, “we”, “us”) operates APOC Wire, a press release distribution service. Content published on APOC Wire is submitted by the companies and organizations that issue those releases. We respect the intellectual property rights of others and expect our users to do the same.

This policy explains how to report content on APOC Wire that you believe infringes your copyright, how we respond to those reports, and how a user whose content was removed can dispute that removal.

This policy is written with reference to the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. Reporting copyright infringement

If you believe content on APOC Wire infringes a copyright you own or are authorized to act for, send a written notice to our designated agent at the address in Section 2 below.

To be effective, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work you claim has been infringed. If your notice covers multiple works at APOC Wire, a representative list of those works.
  3. Identification of the material you claim is infringing, with enough detail for us to locate it. Please include the full URL of each page in question. A notice that does not identify specific URLs may delay our response.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or are authorized to act on the owner’s behalf.

An incomplete notice may not be sufficient for us to act on. If you are unsure whether the material you are concerned about is infringing, you may wish to seek legal advice before submitting a notice.

Please use the subject line above so your notice reaches the right team without delay. Notices sent through our general contact form may take longer to process.

3. How we respond

When we receive a notice that meets the requirements in Section 1, we will:

  1. Review the notice and the material identified in it.
  2. Remove or disable access to the material we determine to be infringing, or that is the subject of a compliant notice.
  3. Notify the user who submitted the material, and provide them with a copy of the notice.
  4. Inform the user of their right to submit a counter-notification.

We aim to review complete notices promptly. We may decline to act on a notice that does not meet the requirements above, and we may ask you for further information.

Content published outside APOC Wire. Releases distributed through APOC Wire may be republished by third-party media outlets, aggregators, and wire services. We can remove material from APOC Wire, but we do not control third-party sites and cannot remove material from them. You will need to contact those sites directly.

4. Repeat infringers

We terminate the accounts of users who repeatedly infringe the copyrights of others. We decide what counts as repeat infringement based on the circumstances of each case, including the number and nature of the notices we receive.

5. Counter-notification

If your material was removed and you believe the removal was a mistake, or that you have the right to use the material, you may send us a counter-notification.

Your counter-notification must include all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed, and the location where it appeared before it was removed.
  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or — if your address is outside the United States — of any judicial district in which APOC Wire may be found, and that you will accept service of process from the person who submitted the original notice or their agent.

Send counter-notifications to the designated agent in Section 2, with the subject line Copyright Counter-Notice.

If we receive a valid counter-notification, we will forward it to the person who submitted the original notice. We may restore the removed material in 10 to 14 business days unless that person notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

6. Misrepresentation

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages — including costs and attorneys’ fees — incurred by the alleged infringer, by any copyright owner or its licensee, or by us.

We may also terminate the account of a user who submits false statements under this policy.

7. General

No waiver. Our decision not to act in a particular case does not waive our right to act in any other case.

Changes to this policy. We may amend this policy at any time. Changes take effect when we post the amended policy on this page.

Conflicts. If this policy conflicts with our Terms of Service, the Terms of Service take precedence, except where this policy is more specific.
